Sale of Artworks and Handcrafted Jewellery

These Terms Regulate the Sale of Original Artworks, Certified Reproductions and Handcrafted Jewellery by Galerie Roz In Winter.

Artworks and Jewellery Are Sold by GALERIE ROZ IN WINTER, a Simplified Joint-Stock Company with Single Shareholder with Share Capital of €1,000, With Registered Office at 61 Grande Rue, 77630 Barbizon, Registered at the Melun Trade and Companies Register under Number 905 243 549. Prices

Prices Are Stated in Euros (EUR) Including All Taxes. The Gallery Reserves the Right to Modify Its Prices at Any Time.

VAT and tax regime

Works of art (paintings, sculptures, drawings, engravings, art photographs, etc.) are sold under the special margin scheme provided for in Article 297 A of the French General Tax Code: no VAT is itemised separately on the buyer’s invoice, which bears the mandatory notice “Régime particulier – Biens d’occasion, œuvres d’art, objets de collection ou d’antiquité – art. 297 A du CGI”. The share paid to the artist falls under the VAT franchise-based exemption (Article 293 B of the General Tax Code) and therefore carries no VAT. Jewellery, decorative objects and other new goods, as well as shipping and delivery costs, are subject to VAT at the standard rate of 20%. The gallery’s intra-Community VAT number is FR28905243549.

Payment

Secure Payment by Card Via Stripe. Payment Occurs at the Time of Order. An Invoice Is Sent by Email After Validation.

Delivery

Artworks Are Shipped Within 5 to 10 Working Days After Payment Is Received. Shipping Costs Are Calculated According to Weight and Destination. For Large Artworks, a Specialised Logistics Provider May Be Appointed.

Right of Withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code, you have 14 days from receipt of the artwork to exercise your right of withdrawal, without having to give any reason, except for artworks made to order or clearly personalised (Art. L221-28). To exercise it, notify us of your decision by an unambiguous statement (postal mail or email to artistesrozinwinter@gmail.com), for example using the model form below. Return shipping costs are borne by you. We will refund all sums paid, including standard delivery costs, no later than 14 days after recovering the artwork or proof of its dispatch.

Claims

Any Complaint Must Be Submitted to artistesrozinwinter@gmail.com Within 7 Days of Receipt. Artworks Damaged During Shipping Must Be Reported to the Logistics Provider Immediately.

Consumer Mediation

In Accordance With Articles L612-1 et seq of the Consumer Code, Any Consumer Has the Right to Resort Free of Charge to a Consumer Mediator in Order to Resolve Amicably Any Dispute Between the Consumer and the Gallery, After Having Previously Attempted to Resolve It by Written Complaint. The Details of the Competent Mediator for the Gallery Will Be Communicated on This Page Shortly.

Applicable Law and Disputes

These Terms of Sale Are Subject to French Law. In the Event of a Dispute and Failing Amicable Resolution or Mediation, French Courts Have Exclusive Jurisdiction.
